The aim of this workbook is to enhance your research and writing skills as you learn about
property law. Please pay careful attention to the instructions for each question.

You are expected to

Answer all questions A-D

Type your work in this document in Arial Font (12 point font size) or similar. Save your
work as you go and then submit the final version via the submission point on BLE.

You must use the OSCOLA system of referencing. If you have any questions about this
system of referencing, please refer to the 4th edition of OSCOLA. You can find a quick
referencing guide here and here.

You should answer the questions over the course Terms 1 and 2. Feel free to discuss
the questions with your colleagues. However, please be careful not to copy from each
other as this may amount to plagiarism.

This assessment must be submitted via BLE by the date and time shown there.

Question A (30 marks).

The aim of this question is to test your research, paraphrasing and referencing skills.

Using the SOAS library website, find an article titled ‘I, me, mine’: Bodies, Parts and
Property’ by Andrew Grubb. It was published in volume 3 of a journal titled Medical Law
International in 1998.

The article is written in response to the question of whether the body can be considered
property. In the space below, in 500 words or fewer, provide a summary of the article.

Make sure you include one direct quote of 1 line.

Make sure you include one direct quote of more than three lines.

Both these quotes must be relevant and properly embedded in your answer. For guidance
on how to embed quotes please refer to the OSCOLA guide.

Make sure you provide proper footnotes to your answer and include a bibliographic
reference at the end of your answer. The references should be to the page numbers in
the journal article, not the website from where you found it.

Question B (30 marks)

This question tests your ability to find cases, compare them and express their reasoning
in your own words.

Go to Westlaw. Find a 2009 Chancery Division decision Port of London Authority v Rupert
Gerald Ashmore

In 500 words or less, provide a summary of the facts, the decision, and the reasoning of the
case.

Include one 1-line direct quote and one 3-line direct quote. For illustrations on how to embed
quotations, please refer the OSCOLA guide. When providing footnotes, please refer to the
reported judgment not to a website.

Next, while staying in Westlaw, find a 2017 case where the Port of London Authority v Rupert
Gerald Ashmore case was not applied.

In 200 words or less provide a summary of this latter case and explain why you think the
judges in these two cases arrived at different decisions.

Provide proper footnotes and bibliographic references.

These are questions from last year’s exam. Provide an answer outline to the following
question. An outline will tell us briefly, the main argument, the structure of the argument

Laila is the registered proprietor of the freehold of Darkacre. Darkacre comprises a large
house set in substantial grounds in which there are several barns. In 2015 Laila granted
Rahim, who lives in the local village, a five-year valid legal lease to use one of the empty
barns to establish his new part-time metal work business. After granting Rahim the lease
Laila continued to keep her surplus art materials in the loft in the barn, as Rahim did not need
the space for his own use. A year later, in 2016, she gave Rahim permission to park his van
on the driveway behind Darkacre, as it was safer than parking it on the busy main road
outside his own house. She also allowed him to use a remote corner of the Darkacre’s
grounds to practice martial arts. In 2020 Laila renewed Rahim’s lease for a further five years.
Last week, after a disagreement, Laila told Rahim that he must stop parking his van on the
driveway belonging to Darkacre and refrain from using the grounds for martial arts. Rahim
has replied by telling Laila to remove her art materials from the loft space in the barn.

Advise Rahim

“We should not allow the beneficial interest in land to be acquired without writing unless there
is clear evidence of intention.”

Explain and critically evaluate how trusts arise in land without writing.
