First, before completing the final Demand Letter, Ivy wants you to draft only the persuasive facts section to be used in the final Demand Letter. Ivy will review the persuasive facts section and discuss it with you prior to final revisions, as needed.

Analyze the facts in the Folly case in the FACTS FOR PROJECTS section of the MAJOR PROJECTS INFORMATION in Content.

• Present the facts in the most persuasive manner as the Demand Letter is an advocacy document. (It is not an objective presentation as in the Complex Office Memo).

• Present the analysis in no more than 3 paragraphs. Most of the facts in Folly’s case are legally significant facts; add only those background facts that are needed for context.
